Congressman Mike Flood has joined House Majority Leader Steve Scalise and Senator Ted Cruz in filing a Supreme Court amicus brief in the case Donald J. Trump v. Norma Anderson, et al. The brief supports former President Donald Trump's appeal to remain on the ballot in the State of Colorado for the upcoming presidential election.
In the brief, Congressman Flood expresses concern over the precedent set by the Colorado Supreme Court's ruling to remove Trump from the ballot. He states, "Tossing political opponents from the ballot is a dangerous precedent to set for our country and opens the door to political parties trying to decide elections before a single vote has been cast." Flood emphasizes the need to protect the democratic process and the future of the American republic.
The amicus brief argues that the Colorado Supreme Court's decision disregards the prerogatives of members of Congress. It criticizes the court for adopting a broad and ill-defined view of "engage in insurrection," which could be easily abused to block political opponents from assuming office. The legislators urge the U.S. Supreme Court to reverse the Colorado Supreme Court's decision.
Majority Leader Steve Scalise echoes these concerns, stating, "President Biden and his radical allies are attempting to undermine the central component of the democratic process – the people's power to choose their leaders through elections." Scalise emphasizes that the Colorado Supreme Court has no authority to remove Trump from the ballot and warns against the dangerous precedent it sets.
Senator Ted Cruz also emphasizes the importance of defending democracy and the Constitution's separation of powers. He states, "The radical left consistently does what they claim their opponents are doing. While President Biden and his allies claim they are defending democracy, their supporters are working to undermine democracy by banning Biden's likely general election opponent from appearing on the ballot."
The amicus brief filed by Congressman Flood, Leader Scalise, Senator Cruz, and their colleagues calls for the U.S. Supreme Court to carefully consider their arguments and reverse the decision made by the Colorado Supreme Court.
